Terms of Use

Please read these Terms of Use (“Terms”) carefully before using the Prepost mobile application (the “App”) operated by Prepost (“we,” “our,” or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

Prepost is a fleet inspection management application that enables truck owners to manage their fleets and drivers to perform pre-trip and post-trip inspections. The App allows users to capture inspection photos, record odometer readings, and manage truck and fleet data.

2. Eligibility

You must be at least 18 years old to create an account and use the App. By using the App, you represent and warrant that you meet this eligibility requirement.

3. Account Registration

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

4. Subscriptions and Pricing

Free Tier

All users may manage one (1) truck at no cost. The free tier includes full inspection functionality for a single truck.

Prepost Pro Subscription

To manage unlimited trucks, a paid subscription is required:

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

Managing Your Subscription

You can manage or cancel your subscription at any time through your Apple ID account settings:

Refunds

All subscription payments are processed by Apple. Refund requests must be directed to Apple in accordance with their refund policies. We do not have the ability to issue refunds for purchases made through the App Store. You may request a refund from Apple at reportaproblem.apple.com.

You retain ownership of all content (including photos and inspection data) that you upload to the App. By uploading content, you grant us a limited, non-exclusive license to store, display, and process your content solely for the purpose of providing the App's services to you and your fleet.

7. Intellectual Property

The App, including its design, features, code, and content (excluding user-generated content), is owned by Prepost and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

8. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Prepost is a tool to assist with fleet inspection management. It does not replace regulatory compliance requirements. Users are solely responsible for ensuring their inspections meet all applicable federal, state, and local regulations.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PREPOST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Prepost and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you of any material changes by posting the revised Terms within the App or on our website with an updated effective date. Your continued use of the App following any changes constitutes your acceptance of the revised Terms.
